In California, you may request a dissolution of marriage based upon one of two grounds:
1. Irreconcilable differences
2. Incurable insanity
To file based upon irreconcilable differences, all you have to do is check the box on the Petition. The court does not inquire as to the reasons for the divorce.
To file based upon incurable insanity, which is almost never used, medical proof that one spouse was insane when the petition was filed, and that the party remains incurably insane, is required.
